This Privacy Statement explains how Delta Plastics of the South, L.L.C. a company of Revolution Plastics Holdings L.L.C. and its controlled affiliates (“Delta Plastics,” “we” or “us”) collect, use, and disclose information and data through the Service (defined below). Delta Plastics offers www.deltaplastics.com, www.pipeplanner.com, https://www.revolutioncompany.com/spotter and any other websites or Apps that reference or link to this Privacy Statement, including all associated content, communications, tools, features, functionality and services (collectively, the “Service”), subject to the terms of this Privacy Statement. Use of our Service is also subject to our separate Terms of Service. This Privacy Statement also answers specific questions concerning the privacy and security of collected information and data.

 


 

1. Types of Information and Data We Collect

Delta Plastics collects “Personal Information” and “Irrigation Related Data.”

Personal Information is information that can be used to personally identify, locate, or contact you. The following types of Personal Information may be collected:

Contact Information that allows us to identify and communicate with you such as your full name, physical location, mailing address, telephone number, email address, username, GPS points and other identifying information that you provide to us when you use our web, mobile applications Pipe Planner, Push for Pick Up, join a newsletter, or interact with us for other purposes.

Irrigation Related Data is information that describes characteristics of your fields, crops and irrigation related practices. The following types of Irrigation Related Data may be collected:

Irrigation Plan Data is information that relates to the physical characteristics of your field and water sources and how these data are used to design an efficient irrigation system. These data may include field boundaries, well/riser locations, location of polytube, size and type of polytube, furrow spacing and direction, elevation points, levy locations and height, crop type, soil characteristics and other technical information related to the field layout and design of an irrigation plan. We treat GPS points associated with Irrigation Related Data as Personal Information.  

Irrigation Event Data includes information you use to schedule irrigation events and data you record to track specific irrigation events or rainfall throughout the season and year after year.

 

2. How Delta Plastics May Collect Information and Data

Directly from You: We collect Personal Information and Irrigation Related Data directly from you. We will ask you for your Contact Information when you interact with us through the Service, when you register on any of our websites such as: www.deltaplastics.com, www.pipeplanner.com, https://www.revolutioncompany.com/spotter, etc., or sign up to receive a newsletter. We will ask you for Irrigation Related Data when you use our web or mobile application Pipe Planner (available at www.pipeplanner.com) , Spotter, push for Pick up to create irrigation plans for your fields or select where to pick up pipe from. As indicated above, we treat GPS points associated with Irrigation Related Data as Personal Information.   At times, you may also be asked to voluntarily give us information for additional reasons indicated through the Service. We only collect Personal Information and Irrigation Related Data that you voluntarily provide to us. Information you submit to us is also subject to our Terms of Service, including without limitation, requiring that it be original to you and you have the right to provide it to us.

From Third-Party Data Suppliers: We may receive information about you from third-party sources to enhance our files and to assist us in understanding our customers and completing purchases.

From Social Media Sites and Mobile Applications: We may collect information about you from social media sites if you “like” our pages or join our communities as well as when you use our mobile applications. Your use of any third-party platforms or applications is also subject to the terms of use and privacy policies of such third parties.

From Our Controlled Affiliates, Dealers, and Other Business Partners: We may collect Personal Information from our dealers and affiliates to verify information and complete transactions.

From Our Website: When you interact with us online, we use cookies and other technological tools to collect information about your computer and your use of our website and applications. We treat this information as Personal Information when it is associated with your contact information.

 

3. How Delta Plastics Uses Information and Data

Delta Plastics and its affiliates use Personal Information and Irrigation Related Data for a variety of purposes, including:

  • Customer Service and Support: to provide you with the products and services you request, perform our customer service and support roles, administer, manage, and improve the Service, and develop existing and new products and services.
  • Marketing: to provide you with communications and offers for products and services from us.
  • Surveys and Promotional Events: to help us administer surveys, polls, sweepstakes, contests, loyalty programs, and other promotional events.
  • Communications: to provide you with certain information, announcements, or reminders.
  • Management of Business Needs: to manage accounts, contracts, websites, web-forums, fraud protection tools, corporate governance, and legal compliance.
  • Web-based Applications: to provide and improve services like Pipe Planner and other applications.

 

4. Why Information and Data are Disclosed by Delta Plastics

Delta Plastics understands that you may not want us to provide Personal Information and Irrigation Related Data to third parties for their own marketing purposes. We limit our sharing of Personal Information and Irrigation Related Data as follows:

  • We may share Personal Information and Irrigation Related Data with our affiliated companies, suppliers, authorized Delta Plastics distributors, and business partners for the listed reasons above.
  • We may use third parties to help operate the Service, deliver and improve our products and services, and develop new products and services. We may share information about you, including Personal Information and Irrigation Related Data, with these third parties for these purposes and do not authorize third parties to use your information for other purposes.
  • We may disclose Personal Information and Irrigation Related Data where needed to support external audits and compliance. We reserve the right to disclose any information as needed if that information is requested by law enforcement agencies or if we are required to do so by applicable law. We reserve the right to transfer any information we have about you in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation of our business.

Please note that we may also disclose other information and data about you that is not personally identifiable. For example, we may publish reports that contain aggregated and statistical data about our customers and irrigation activity. These reports do not contain information that would enable the recipient to contact, locate or identify you.

 

5. Why You May Choose to Share Information with Other Users or Third Parties

Certain features within the Service, including the Pipe Planner web application, may allow you to share information with other users, our distributors or our business partners. Reasons you might choose to share your information with others may include:

  • Sharing an irrigation plan with an employee or contract worker to install the designed plan
  • Sharing an irrigation plan with a grower, extension agent or researcher for educational purposes
  • Providing information to a consultant to facilitate an irrigation plan design
  • Sharing a compiled list of equipment needed (e.g.; polytube roll quantities and sizes, connections, accessories) with an irrigation equipment provider to facilitate an order
  • Other information sharing to facilitate your business purposes

You may choose to share your information with other parties within our Service or through Pipe Planner at your own discretion. Delta Plastics cannot take responsibility for the privacy of information shared with other users or third parties with whom you have independently chosen to share such information.

           

6. Cookies and Other Automatic Collection Technologies

When you interact with the Service, including by using our web applications or mobile application, we may use technologies that automatically or passively collect information, including:

Cookies: When you visit our website, we place cookies, which are small text files that websites send to your computer or other internet-connected devices, on your computer to uniquely identify your browser or to store information or settings in your browser. Cookies help us identify you when you return to our website, customize your experience, and enable us to detect some forms of fraud.

Flash Cookies: Flash Cookies and similar technologies are used to personalize and enhance your online experience by remembering settings, preferences, and usage similar to browser cookies.

Pixel Tags: These small, transparent graphic images, sometimes called a web beacon or tracking beacon are placed on a web page or in an email to indicate that a page or email has been viewed. These tools allow us to measure response to our communications and improve our web pages and promotions.

We may collect many different types of information from cookies and other technologies such as information about your device, operating system, browser, domain, other system setting, language, and country and time zone in which the device is being used. We may also record your IP address of your device which acts as a unique identifier. In the event that any such information can be used to identify you, we will treat it as Personal Information under this Privacy Statement.

We use information gathered through these tools to improve the way our Service works, for example by employing third-party analytics tools which aggregate anonymized user information to help us better design our Service, and to enhance the functionality of our Service, for example by remembering preferences or other choices that you make, such as user names and the like. By allowing us to understand how you use our Service over time, these tools can help us provide you with a better, more relevant online experience.

 

7. Transfer of Information

Delta Plastics is based in the United States of America. Any personally identifiable information you provide may be stored and maintained in a secure database in the United States or transferred to a secure database outside the United States. By providing us with your information, you consent to this transfer.

 

8. Your Choices

You can limit the information you provide to Delta Plastics as well as the communications that Delta Plastics sends to you.

If you receive a newsletter or similar promotional email from us, you will be given the option to opt-out from receiving further emails. Your election not to receive promotional and marketing material will not preclude us from corresponding with you, by email or other means, regarding your existing or past business relationships with us.

You can manage cookie preferences and similar technologies. You can opt-out of having cookies and other similar collection technologies used by changing the settings on your browser or interface. The “help” section of your browser or interface will contain information on cookie preferences and privacy settings. Some aspects of our website and applications may not function as intended if your setting choice is set to block cookies.

You control the Irrigation Related Data you input into Pipe Planner. Pipe Planner requests Irrigation Plan Data such as field boundaries, well/riser locations, furrow spacing and direction, elevation points and other data to help calculate an efficient irrigation design. Limiting the data that you input into Pipe Planner may limit the software’s ability to provide you with a valid irrigation plan. Pipe Planner also includes additional irrigation event recording or scheduling tools to track the irrigation activities and rainfall that occur on your fields. These tools are designed to help track the effectiveness of the irrigation plans and help users improve their irrigation efficiency through improved management. By limiting the amount or accuracy of the data you input into Pipe Planner, you may limit the program’s ability provide recommendations to improve your irrigation water use.

You can manage how your mobile device and mobile browser share location information and handle cookies and other collection technologies. To learn how to adjust these privacy and security settings, refer to the instructions provided by your mobile service provider or device manufacturer.

 

9. Tracking

Do Not Track Requests. We do not presently have the capability to omit you from our analytics unless your browser settings are configured to make your online activity invisible to analytical tools.

Third Party Tracking. Third parties, other than our vendors (such as our website analytics provider), do not have authorization from Delta Plastics to track which websites you visited prior and after visiting our website. That said, we cannot control third party tracking and there may be some third-party tracking that occurs without our knowledge or consent.

 

10. Access, Correction, and Control

Delta Plastics complies with applicable law regarding your ability to access, correct, and delete your Personal Information. You may log into your account to access and update certain information you provided to us. If you need assistance updating or deleting your Personal Information, please contact us via email to privacymanager@revolutioncompany.com. If you send us a letter, please provide your name, address, email address, and detailed information about the change you would like to make.

 

11. Information and Data Security

We use reasonable precautions, including appropriate technical, administrative, and physical procedures, to protect Personal Information from loss, misuse, or alteration, as appropriate to the sensitivity of the information in our control. Although guaranteed security does not exist on the Internet or offline, we make commercially reasonable efforts to handle such information consistent with this Privacy Policy and applicable laws. Due to the design of the Internet and other factors outside our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third parties.

 

12. Children’s Policy

Our websites and services are not intended to be used by or collect Personal Information from children, especially those under the age of 13. No one under the age of 13 should provide any personally identifiable information to us, and we do not knowingly collect such information from such children. If we learn that we have collected the personally identifiable information of such a child we will take steps to delete the information as soon as possible. Children under the age of majority in any non-U.S. jurisdiction should also not provide us with any personally identifiable information.

 

13. Forums, Product Reviews and Other Public Areas

Our Service may contain forums and other areas that allow you to publicly post reviews, communicate with others, and submit other content. We encourage you to read our Terms of Service prior to posting in these areas. These postings are considered public and not private. The information you post, including your email, may be accessible to anyone with internet access.

This Privacy Statement only addresses how Delta Plastics collects, uses, and discloses information and data. Other websites or third-party content that may be accessible through our website, including websites of our independent suppliers, will have their own privacy policies.

 

15. California Privacy Rights

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain types of Personal Information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year. We may occasionally update this Privacy Statement. Notice of the updates may be given through our Service and/or personally to you. Your continued use of the Service after we give notice of changes to this Privacy Statement will constitute your acceptance of such changes.
